Fire prevention and fighting standards for restaurants and hotels 2025


    Fire prevention and fighting (PCCC) for restaurants and hotels is an important issue that many people are concerned about, because these are places where fires and explosions are likely to occur and suffer great losses if a fire occurs. So what fire prevention and fighting standards do restaurants and hotels need to meet?

    1. Fire prevention and fighting standards for restaurants
    Based on Clause 6, Appendix III - List of establishments managed by the police agency issued with Decree 136/2020/ND-CP, including restaurants with a total business area of ​​300m2 or more or a volume of 1,000m3.

    Therefore, according to Clause 1, Article 5 of Decree 136/2020/ND-CP, restaurants must ensure the following fire prevention and fighting safety conditions:

    - Have regulations, signs, prohibition signs, diagrams or signs for fire prevention and fighting, and escape routes in accordance with current fire prevention and fighting regulations and standards or in accordance with regulations of the Ministry of Public Security.

    - Have a fire prevention and fighting force at the restaurant, specialized in the type of restaurant, these people must be trained in fire prevention and fighting and organized to be ready to fight fires to meet on-site fire fighting requirements.

    - Have a fire fighting plan approved by a competent authority.

    - Have electrical, lightning protection, anti-static systems, electrical, heat-generating, fire-generating equipment and the use of heat sources and fire sources to ensure fire prevention and fighting safety and in accordance with fire prevention and fighting standards and regulations of the Ministry of Public Security.

    - Have a traffic and communication system for fire prevention and fighting, a water supply system, a fire prevention and fighting database management system and incident reporting system, a fire alarm, fire fighting, fire prevention, smoke, escape system, other fire prevention and fighting equipment, and rescue equipment that ensure quantity and quality, in accordance with fire prevention and fighting standards and regulations of the Ministry of Public Security.

    - Have a design approval certificate, a design approval document (if any) and a document approving the results of fire prevention and fighting inspection by the fire prevention and fighting police agency for the restaurant.

    In addition, the restaurant must also be equipped with fire prevention and fighting equipment such as:

    - Automatic fire alarm and fighting system: This system automatically detects and notifies the location of a fire or explosion, including a fire alarm center, fire detector, ... and other peripheral devices. This system needs to be checked and maintained at least once a year.

    - Smoke exhaust system: The restaurant's kitchen area must be equipped with at least 2 smoke exhausts. The smoke exhaust is where a lot of grease and exhaust fumes accumulate during cooking, so it is very easy to catch fire when exposed to high temperatures. Therefore, the restaurant needs to check and clean the smoke exhaust system once a month to ensure safety.

    - Portable fire fighting equipment: In order to immediately handle small fires and avoid spreading into large fires, the restaurant must be equipped with portable fire fighting equipment placed in visible places to handle situations promptly and quickly.

    Based on the content of Clause 7, Appendix III - List of establishments managed by the police agency issued with Decree No. 136/2020/ND-CP, accordingly, hotels with 5 floors or more or with a volume of 1,500m3 or more are included in this list.

    Therefore, hotels also need to ensure fire prevention and fighting safety conditions according to the provisions of Clause 1, Article 5 of Decree No. 136/2020/ND-CP as well as the fire prevention and fighting conditions for restaurants mentioned above.

    3. Are hotels subject to fines for not posting fire prevention and fighting regulations?

    According to the provisions of Clause 3, Article 29 of Decree No. 144/2021/ND-CP regulating the level of penalties for violations of regulations on promulgation, dissemination, implementation of regulations, signs, level signs, diagrams, and signs on fire prevention, fighting, rescue, accordingly, the act of not posting regulations on fire prevention, fighting, rescue will be fined from 1 to 3 million VND.

    Note that the above fine applies to administrative violations of individuals, for organizations with the same violation, the fine is 02 times the fine for violating individuals (based on the provisions of Clause 2, Article 4 of Decree No. 144/2021/ND-CP).

    Thus, in case the hotel does not post the fire prevention and fighting regulations, it may be fined: From 01 - 03 million VND (for individuals who violate) and from 02 - 06 million VND (for organizations that violate).
